This site was created from my experience fighting for justice in the case of the "Medicare Murder" of my mother, Zoe.  I had my high school view of justice,  separation of powers and sanctity of law -  very naive, to  speak mildly! I now recall my father speaking of the corrupt Long Branch, NJ judges in my childhood. Had it changed since then? Yes, but not for the better. In a country, where a Supreme Court judge [Scalia] finds it proper to go duck hunting with old friend VP Cheney with his case pending before him, could it be worse? No, there is no longer any need to hide improprieties.

A law suit is the 2nd nightmare for the victims of malpractice. Here some are tyrannized by the legal system. Occasionally there are corrupt lawyers and judges in a defective legal system. The system caters to the wealthy and corporations. Falsification of medical records hurts each victim's case. Less than 2% of cases ever make it to trial and settlement. These cases are often called "FRIVOLOUS".  There is no such thing as a "frivolous" med-mal case. There is a damaged patient. Against this person is a whole set of laws, which are against the universal premise of equality before the law. The entire medical , drug and insurance corporations are stacked against the victims.

Among the experienced, our legal system  is called "a horse and pony show" and we, the people, are sure not cracking the whip.  The guy with the most money will win in the end and those without it will not even get to court or if charged with a crime will get sentenced quick.

A case is not taken by a lawyer based on right or wrong, but on how much money there is to be made.    Fighting for justice is the quickest way to go broke.

Very few people trust lawyers. Well, people, the judge is only a lawyer in an ugly black dress, so why should you trust him?    Not that they might not want to be fair, but the system calls for vested interests to win and is set up accordingly.

Scott Whonsetler won malpractice defense verdicts in 20 of the 22 cases he tried between 1998 and 2002, according to the Kentucky Trial Court Review.
The sanction arose from a  malpractice lawsuit filed in 1997, which was settled  for $425,000 based on his statement that he had an expert witness to testify on the doctor's behalf.This was not true, but the bluff led to a settlement to avoid an ugly costly lawsuit.
According to court records patient Gilland, 38, had sued Dr. David Petruska and two other physicians. She had a herniated disc. Petruska negligently fused her spine at the wrong place, because a radiologist miscounted the discs and marked the wrong location on her X-ray film.

2.   'The Rest Of The Story'  [From Paul Harvey's "The rest of the story"]

If there is a stain on the record of our forefathers, a dark hour in the earliest history of the American Colonies, it would be the hanging of the "witches" at Salem.

But that was a pinpoint in place and time-- a brief lapse into hysteria. For the most part, our seventeenth century colonists were scrupulously fair, even in fear.

There was one group of people they feared with reason-- a society, you might say, whose often insidious craft had claimed a multitude of victims, ever since the Middle ages in Europe.

One group of people were hated and feared from Massachusetts Bay to Virginia. The Magistrate would not burn them at the stake, although surely a great many of the colonists would have recommended such a solution. Our forefathers were baffled by them.

In the first place, where did they come from? Of all who sailed from England to Plymouth in 1620, not one of them was aboard.

"VERMIN." That's what the Colonist called them. Parasites who fed on human misery, spreading sorrow and confusion wherever they went. "DESTRUCTIVE." They were called.

And still they were permitted coexistence with the colonists. For a while, anyway. Of course there were colonial laws prohibiting the practice of their infamous craft. Somehow a way was always found around all those laws.

In 1641, Massachusetts Bay colony took a novel approach to the problem. The governors attempted to starve the "devils" out of existence through economic exclusion. They were denied wages, and thereby it was hoped that they would perish.

Four years later, Virginia followed the example of Massachusetts Bay, and for a while it seemed that the dilemma had been resolved.

It had not, somehow the parasites managed to survive, and the mere nearness of them made the colonists skin crawl.

In 1658, In Virginia, the final solution: Banishment; EXILE. The "treacherous ones" were cast out of the colony. At last, after decades of enduring the psychological gloom, the sun came out and the birds sang, and all was right with the world. And the elation continued for a generation.

I'm not sure why the Virginians eventually allowed the outcasts to return, but they did. In 1680, after twenty-two years, the despised ones were readmitted to the colony on the condition that they be subjected to the strictest surveillance.

How soon we forget!

For indeed over the next half century or so, the imposed restrictions were slowly, quietly swept away. And those whose treachery had been feared since the Middle ages ultimately took their place in society.

You see, the "vermin" that once infested colonial America, the parasites who prayed on the misfortunes of their neighbors until finally they were officially banished from Virginia, those dreaded, despised, outcasts, masters of confusion were lawyers.

3. A lawyer opened the door of his BMW, when suddenly a car came along and hit the door, ripping it off completely. When the police arrived at the scene, the lawyer was complaining bitterly about the damage to his precious BMW.
"Officer, look what they've done to my Beemer!" he whined.
"You lawyers are so materialistic, you make me sick!" retorted the officer, "You're so worried about your stupid BMW, that you didn't even notice that your left arm was ripped off!"
"Oh my God", replied the lawyer, finally noticing the bloody left shoulder where his arm once was, "Where's my Rolex?"

4.  The Altruistic Barber

A barber gave a haircut to a priest one day. The priest tried to pay
for the haircut but the barber refused saying "you do God's work."
The next morning the barber found a dozen bibles at the door to his shop.

A policeman came to the barber for a haircut, and again the barber
refused payment saying "you protect the public." The next morning the
barber found a dozen doughnuts at the door to his shop.

A lawyer came to the barber for a haircut, and again the barber refused
payment saying "you serve the justice system." The next morning the
barber found a dozen lawyers waiting for a haircut.



NO JOKE

1. Harvey Kash and Carl Lanzisera, Americans for Legal Reform, were arrested in a Nassau County court on January 10, 2005 for telling the following joke:
"How do you tell when a lawyer is lying?         His lips are moving."

This may explain why telephone hearings are so popular?!


2. Malpractice trial derailed when doctor treated collapsed juror in SALEM, Mass.
The doctor being sued  for childbirth brain damage  at North Shore Medical Center rushed to the aid of a juror who collapsed. A mistrial was declared.
