Richard Tyus witnessed the incredible care of his mother at Baptist Medical Center in Montgomery, Alabama. The horrendous treatment has been affirmed by ER Doctor and managed care director, Charles Phillips of California, as well as the state investigative agency, yet nothing is happening to punish or prevent such events from happening again.  No accountability, yet scandalous events are taking place.  This story is unbelievably heart breaking. Can you imagine taking your mother to the ER for a fall and seeing them allow her to die the same day from a painkiller overdose?
Case narrative:
I took my 71-year-old mother to the ER by ambulance after a fall.
She received a shot for the pain.
They said it was morphine.
They released her, while she was having a reaction. An ambulance took her home.
After arriving at home, 15 minutes, I called for an ambulance to take her back to the hospital
The ambulance came, but they refuse to take her back per conversation with Dr. Shaw, the ER doctor at the hospital. She went into respiratory arrest.
I called 911 again and they came out and took us but she died going into the ER. She died in the ER.
This is where the story gets interesting.
The hospital head nurse called the coroner's office and told them that my mother died of a natural death.
I called them right back and told them that it was drug related. And requested a police officer to do a report of the incident.
The police came out and wrote that the coroner's office called them out on a natural death but the doctors said the cause of death was unknown.
The police department refused to investigate the case.
The hospital asked if I wanted they to do an autopsy and I said NO because they lied to the coroner's office 5 minutes after my mother had died and that I did not trust them. I would find someone to do the autopsy myself.
I called the coroner's office about the incident over a 7 day period to determine if they would do and autopsy and they never responded. So I found someone to do it for me out of Kansas.
On the day of the autopsy, I went to funeral home and found the pathologist taking samples from the wrong body. When I approached him about it, he said the owner of the funeral home gave him the wrong body. I did not believe him, but I gave him the right body myself and WAITED THERE ALL DAY FOR HIM TO FINISH.
When I got the autopsy report back there was no morphine in the samples nor narcan, which the hospital said they gave, but strange enough, they found Ibuprofen, that she was not on.
What' s wrong with that picture???????????
I reported this to the FBI, who refuse to investigate .
I reported this to the Attorney Generals, office who refused to investigate.
I reported this to the DA's office, who refused to investigate.
After a investigation of my own, I found out that the county coroner works at the hospital.
I believe that the coroner's office is the one who paid my pathologist to dummy up the autopsy report.
Since then IT APPEARS, the board of medical examiners and others including the board of nursing has conspired to cover this event up.
They appear to have blackballed me in the State by not letting any attorney take the case.
After a letter to the White House, an attorney out of Birmingham took the case.
After taking the case, he refused to talk to me for seven months about the case. And he appears to have lied to me on 3 different occasions about different things.
In 9 months he never took a deposition or got one subpoena any records nor would he let me tell him anything that I knew about the case.
He refused to amend the complaint to allege the EMTALA violation and withdrew from the case after he knew the 120 day rule for amending the complaint had passed.
Now you tell me what just happened.
In conclusion: The coroner office must have been doing this for a long time and this case could open the doors to other investigation into deaths that have occurred in that Emergency Room.
They are hiding something very bad and this case could be the key to a lot of prison time for a lot of people.
And that Ladies and Gentlemen, this is why I don't have an attorney and probably won't be able to get one.
I would love to be wrong and have an attorney help me fight this injustice. Unfortunately, this is not just an single case. It is happening several times daily across the country. The only thing different is my unwillingness to give up. This is Medical malpractice and negligence on a huge scale and the tragedy is the lack of accountability by these medical and judicial professionals, whom we have been brought up to trust. PLEASE HELP.
Another autopsy would cost me $7,800.00 and that would close the case because I think the defendants would give up before anyone goes to prison.

John McCormack  succeeded like few healthcare injustice fighters. 
The hospital negligent death of his 13 month old baby daughter Taylor is especially tragic. 
She was bumped from emergency surgery.  John fought and made his case so strong that this year he succeeded in getting Massachusetts to pass a law allowing medical complainants to sit in on the hearing of the doctors' negligence and present evidence -

"Taylor's Law."
 
Incredible as this may seem, in many states this is impossible.  Victims of med-mal are left outside the investigation.  Although the complainant could prove that the medical records given to the state for review are fraudulent, they are never given a chance. This leads to incredible bad practices to continue and harm healthcare for all. Florida is especially bad as evidenced by my mother's case.
